This suggests that torres likely agrees with the SEC on that issue in her SJ. (Also, this info getting public will cause damage to ripple/xrp and third parties working with ripple, not even talking about the new FUD this will evoke) I really wish this sh!tshow would end already and xrp gets clarity, but you all need to adjust your expectations as the social media people wont tell you the bad aspects of all things re xrp - they are selling sh!t as great news to keep you engaged. Regarding your comment, it could be a slightly pessimistic view. Obviously, in the light of the Howey test definitions, those sales need to be considered in order to verify whether those sales make the Howey test affermative. In other words, without those sales such an analysis cannot be performed. I don't read this as an analysis by the court which confirms the SEC's view but I'm also aware that hope or "wish is the father of the thought" (Dutch expression).
