Hal, i`m sry to always seem to be contrary to your optimism and it really is nothing personal - but I just cant agree with your and most of xrp communities sentiment here.

IMO this recent ruling is not that good for ripple/xrp

First - the expectations on the content of this mail drafts have propelled to heavens and I think many will be very disappointed as soon as the docs are public. Also, ripple cited the hinman docs in their motion for SJ and only redacted 2 words (or so), you`d expect them to put the most damaging parts into their motion and off this damaging parts only a few words got redacted (which will be unsealed soon) - therefore, dont expect some ultra damaging or corrupt exposure from this.

Second - as most xrp people on social media trying to completely ignore is the fact that judge torres also ordered financial data to ripple's xrp sales and payments to third parties to get unsealed and she states those "directly pertains to the howey analysis". This suggests that torres likely agrees with the SEC on that issue in her SJ. (Also, this info getting public will cause damage to ripple/xrp and third parties working with ripple, not even talking about the new FUD this will evoke)

 

I really wish this sh!tshow would end already and xrp gets clarity, but you all need to adjust your expectations as the social media people wont tell you the bad aspects of all things re xrp - they are selling sh!t as great news to keep you engaged.

Thanks for your non offensive feed back VanHasen, I think this is how public forums should work.

Regarding your comment, it could be a slightly pessimistic view. Obviously, in the light of the Howey test definitions, those sales need to be considered in order to verify whether those sales make the Howey test affermative. In other words, without those sales such an analysis cannot be performed. I don't read this as an analysis by the court which confirms the SEC's view but I'm also aware that hope or "wish is the father of the thought" (Dutch expression).

I have no issues with anybody's opinions or analysis, but I was listening in on John Deaton's Twitter spaces callin a few hours ago and he ended on these words...
