Dude I think this amendment was published first and then a much worse amendment was put forward at the last minute in opposition to this. The White House came out last night in support of the BTC - planet destroying amendment over this one you posted.

We need to fight misguided attempts to pick technological winners and losers, but we can't lose sight of another important difference between the Warner-Portman-Sinema amendment and the Wyden-Lummis-Toomey amendment.

Unlike the Warner amendment, the Wyden amendment rightfully exempts protocol devs that aren't middlemen from the definition of "broker." Even if the Warner amendment were fixed, so it didn't cover just one type of validator, it would still be deficient for this reason.

The PoW-specific craziness that came from left field last night has galvanized folks because it would be so disastrous, but we also have to remember why we were fighting in the first place. People who only write and publish code are not middlemen or "brokers."

They are only employing their right to free speech protected by the First Amendment. It would be beyond wrong to tell open source devs that they can only write software that surveils and reports on the users of their code.

This is why not only must the Warner amendment fail, but the Wyden-Lummis-Toomey amendment must pass.
