If Ripple is proved innocent and Ripple/XRP fail to recover, then maybe. If not, the SEC is righting Ripple's wongdoings and the price dumped because of Ripple's fraud. Maybe Holland hasn't sovereign immunity for gov entities but that's irrelevant, the SEC isn't Dutch. Yes i agree with your sentiment generally, just saying, in order to remove that protection and successfully sue, you would probably have to prove Jay Clayton had malicious intent or took bribes from Goldman Sachs, or whatever.
