Because you have essentially variations of 2 options

1) have the ledger track every account that has an unlock condition and then keep a running list and on every ledger close, cross ref the current conditions with the escrow unlock rules

2) make it so that someone sends an unlock message once the condition has already been met

1 requires a lot of bookkeeping and making the software do a lot of work on every ledger which is 99.9% wasted since only occasionally does a condition actually match and need attention.

2 is dead simple and you can either make it so that only the account that created the escrow can unlock it (what if the account holder has lost a key or spent all his coins and no longer pays any interest in it?) - or only the account that receives the funds could unlock it - what if the receiver doesn't know yet that some condition (smart contract) is depositing funds to him/her?

Simplest way is just let the final unlock transaction be done by any account. Usually nobody will be paying attention to them. In this case Ripple's escrow has quite high visibility so it's no surprise that it attracts attention.
